These are the general terms for using anything Swiftaw makes — Fortized, Lifecheck, and whatever we build next. We've kept them as plain as we can.
The short version: Swiftaw is a French company that builds digital products. Use one, and you're agreeing to these terms plus that product's own rules. We may collect data when a product needs it to work or to get better — but we don't sell it and we don't hand it to advertisers. Everything else is below.
We're Swiftaw, a company based in the Île-de-France region of France. We build and run our own products — right now that's Fortized, a gaming-flavoured chat app, and Lifecheck, a human-check widget. Swiftaw is the company behind them and the one responsible for your data.
We're a French company, so we follow French and European law, including the GDPR and the Digital Services Act. When we say “we” we mean Swiftaw; “you” is the person using our stuff; a “product” is any app, site, API or widget we put out.
These terms are the general ones. They apply to everything we make and set the baseline between you and us. Individual products can add their own rules on top — Fortized, for example, has its own terms over on fortized.com. Those product rules live alongside these; they're written to fit together, not to argue with each other.
If a product's own rule and these general terms ever seem to clash on the same point, the product rule wins for that product and these general terms keep covering everything else. Using any of our products means you're okay with both.
Some products need an account. A Swiftaw account and a product account (like a Fortized one) aren't the same thing — they're separate. Keep your password to yourself, and you're responsible for what happens on your account. If you think someone's got into it, tell us.
When you sign up, give us real details, be old enough to use the product where you live, and don't pretend to be someone else or sneak back in after a ban.
What we do, at heart, is make and deliver digital products. Today that's:
We'll add, change and retire products over time. When we do, these terms cover the new one too, and it may bring its own extra rules. There's a plain rundown of how everything fits together in our Products Policy.
Wherever you are across our products, please don't:
If you break these or a product's own rules, we may pause or end your access.
To run our products and make them better, we may collect data where it's genuinely needed. Depending on the product, that can be your account details (avatars, usernames, passwords — for Swiftaw accounts and product accounts like Fortized), the content you share inside a product like Fortized, and how you use things — including how people interact with Lifecheck, which is how it tells a human from a bot.
We use that to keep the products running and secure, to improve our systems, and to build new things. And here's the promise we care about most:
We don't sell your data, and we don't use it for commercial resale. It's there to run and improve what we make — not to be traded.
Swiftaw owns its products — the code, the design, the logos, the names. Using a product doesn't hand any of that to you; you just get permission to use it the way it's meant to be used.
You keep what you make. When you share something in a product, you give us the permission we need to store and show it there so the product works. That ends when you delete the content or your account, apart from copies the law makes us keep.
We run our products “as is” and “as available.” We aim for solid and reliable, but we can't promise it never breaks or goes down. We may change, pause or retire a product or a feature; if we're shutting something down for good, we'll give reasonable notice where we can.
We'll update these terms now and then. When something meaningful changes, we'll change the date up top and, where it makes sense, tell you in the product. Keep using it after a change and you're accepting the new version.
As far as the law allows, we're not on the hook for indirect or knock-on damage, lost data or lost profit from using a product. None of this touches the rights you can't sign away — your consumer rights under French and EU law, or anything to do with injury caused by our negligence, fraud, or deliberate wrongdoing.
These terms follow French law, and the French courts handle any dispute — without taking away the consumer protections you have where you live. If you're an EU consumer, you can also use the EU's Online Dispute Resolution platform.
